The video of Dr. Dan Kyle testifying before the Louisiana Legislative Audit Committee has been placed on You Tube. The testimony by Dr. Kyle reveals the truth behind the facade of James "Buddy" Caldwell. Caldwell touts his years as District Attorney of the rural 6th Judicial District as his greatest qualification for being Louisiana's Attorney General, so it is only fair to look at what kind of DA James Buddy Caldwell has been. The Legislative Auditors Report and Dr. Kyle's testimony peels the skin back on Caldwell's public facade and shows a man who has abused his office and treats public funds as if they are his own personal treasury.
The Legislative Auditor is the part of the Louisiana Government which serves as the watchdog of public spending. The Legislative Auditor is responsible for conducting independent financial and performance audits of the State’s agencies, colleges, and universities, is to find ways to improve government and identify critical issues to protect public resources and tighten government control systems. When necessary, the Legislative Auditor investigates allegations of fraud, waste, or abuse of public money.
Dr. Kyle testified that during his tenure as Legislative Auditor his office received several allegations involving possible improper activities occurring at the District Attorney’s Office for the Sixth Judicial District of Louisiana. Dr. Kyle testified that the United State’s Attorney Office, the Federal Bureau of Investigations, and the Louisiana Attorney General’s Office requested that he investigate Caldwell's office for the Sixth Judicial District of Louisiana. The Sixth Judicial District of Louisiana was comprised of East Carroll Parish, Madison Parish, and Tensas Parish and Caldwell has been the District Attorney for the Sixth Judicial District since September of 1978.
An audit of James” Buddy” Caldwell’s office by the Louisiana Legislative Auditor was performed in 1997. As a result of the audit of James “Buddy” Caldwell’s office, it was determined that it was his practice to conduct District Attorney business by the use of two credit cards. One credit card was a corporate card in the name of the District Attorney’s office and the second was his personal credit card. The audit showed this improper accounting practice had been used by James “Buddy” Caldwell for several years. It was determined that Caldwell made personal charges on the card issued to the District Attorney’s office and would make District Attorney’s office charges on his personal credit card. He would then have the District Attorney’s office pay, with public funds, the balance on both the personal credit card and on the District Attorney’s Office’s credit card and he would at some later time reimburse the District Attorney's office.
However, this practice was revealed because Caldwell did not always reimburse the District Attorney’s Office for personal expenses paid by the office with public funds. From February 1995 to April 1996, the audit shows that there were 17 instances in which personal items and late fees were paid on behalf of Caldwell with public funds and which were never reimbursed.
This practice had been used by Caldwell for years. Using this practice is in and of itself horrible, even if all of the purchases had been repaid but the problem does not stop there. Through this practice Caldwell was able to push off the interest charges on these cards to the public (there is no record that he paid the interest back) and he was able to float the payments so that he had interest free loans from the government until he "repaid" the DA's office. Additionally, he was able to gain a benefit from the charges on his card being paid timely and whatever perks he may have received from the card such as air miles.
Despite this he was never prosecuted. Why? Well the answer is simple. He was the Chief law enforcement official of his Judicial District and any prosecution would have had to have been instituted by his office. How convenient is that. The only other State authority that could prosecute him was the Louisiana Attorney General. Unfortunately for the citizens of Louisiana this was Caldwell's buddy Richard Iyeob. The same Attorney General that Caldwell went and griped to about Dr. Kyle's refusal to deep six the Legislative Auditor's Report and the same Attorney General who testified with Caldwell before the Legislative Audit Committee. How convenient.
Dr. Kyle's testimony also showed that Caldwell went "ballistic" when he was informed of the findings of the audit. Caldwell slurred his own wife (now ex-wife) and went into a disjointed story about how he had IRS, financial and political problems. Dr, Kyle testified that Caldwell made racist remarks concerning the Legislative Auditor’s Report on the Madison Parish Police Jury and stated that Kyle “just needed a white man to prosecute.” He also threatened Dr. Kyle by saying he was going to prosecute him.
Caldwell is part of the problem with Louisiana government. He has been in office for too long and has forgotten that his job is to serve the public. If the people of the 6th Judicial District want to keep him that is their problem, however the people of Louisiana do not need a man like this in the Attorney General's office.
